1. Agreement to these terms
These Terms of Service ("Terms") are a legal agreement between you and [Your Legal Entity Name] ("WisprBee", "we", "us", or "our") governing your access to and use of the WisprBee application, website at wisprbee.com, and related services (together, the "Service").
By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. The Service
WisprBee is an AI-assisted voice keyboard for macOS. You hold a hotkey and speak, and WisprBee transcribes your speech and returns polished text formatted for the application you are writing in.
We may add, change, or remove features at any time. We may also set limits on certain features or restrict access to parts of the Service without notice or liability.
3. Eligibility & your account
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service.
If the Service requires an account, you are responsible for the information you provide, for keeping your credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
4. Subscriptions, billing & payments
Paid plans (currently "Pro" and "Pro Plus") are sold on a recurring subscription basis, billed monthly or annually depending on the plan you choose.
Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Billing, payment processing, and applicable sales tax/VAT are handled by Paddle, and your purchase is also subject to Paddle's Buyer Terms and Conditions.
Auto-renewal
Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date. You authorize us and Paddle to charge your payment method on each renewal. We will make current pricing available on our pricing page; we may change prices, and any change will apply from your next renewal.
Cancellation
You may cancel your subscription at any time from your account or via the Paddle receipt/management link in your purchase confirmation email. When you cancel, you keep access until the end of your current paid period, after which the subscription will not renew.
5. Free plan & trials
We may offer a free plan or free trial with limited features or usage. We may modify or discontinue free offerings at any time. If a trial converts to a paid subscription, the billing terms above apply unless you cancel before the trial ends.
6. Refunds
Refunds are governed by our Refund Policy, which forms part of these Terms. Please review it for details on eligibility and how to request a refund.
7. Acceptable use
You agree not to, and not to permit anyone to:
- Use the Service for any unlawful, harmful, fraudulent, or infringing purpose;
- Reverse engineer, decompile, or attempt to extract source code or model weights, except where permitted by law;
- Resell, sublicense, or provide the Service to third parties as a bureau or service without our written permission;
- Circumvent usage limits, licensing, or security measures;
- Interfere with or disrupt the Service, its infrastructure, or our providers;
- Use the Service to create, transcribe, or process content that is illegal, abusive, or violates the rights of others.
We may suspend or terminate access for violations of this section.
8. Your content & data
You retain all rights to the audio you speak and the text you create with the Service ("Your Content"). We do not claim ownership of Your Content.
You grant us a limited licence to process Your Content solely to operate and provide the Service to you — for example, to transcribe speech and format text. How we handle Your Content is described in our Privacy Policy. You are responsible for ensuring you have the right to process any content you input.
9. Intellectual property
The Service, including its software, design, logos, and branding, is owned by [Your Legal Entity Name] and protected by intellectual-property laws. Subject to these Terms and your active subscription, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the Service for your own personal or internal business use.
10. Third-party services
The Service relies on third-party providers, including our payment reseller (Paddle) and our AI text-processing provider. Your use of the Service may also be subject to Apple's macOS terms. We are not responsible for third-party services, and your use of them may be governed by their own terms.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement.
WisprBee uses automated speech recognition and AI models. Output may contain errors, omissions, or inaccuracies. You are responsible for reviewing all output before you rely on or send it. We do not warrant that the Service will be uninterrupted, error-free, or secure.
12. Limitation of liability
To the maximum extent permitted by law, [Your Legal Entity Name] and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Service.
Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of the amount you paid us in the twelve (12) months before the event giving rise to the claim, or USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold [Your Legal Entity Name] harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service or your breach of these Terms.
14. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will survive.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
16. Governing law
These Terms are governed by the laws of [Your Country / State], without regard to conflict-of-laws principles. The courts located in [Your Country / State] will have exclusive jurisdiction, subject to any mandatory consumer-protection rights you have in your country of residence.
